The CMI Lex Maritima 2025 − The Tokyo Principles of Maritime Law

CMI Lex Maritima 2025 (Tokyo Principles of Maritime Law) was adopted by the General Assembly of the Comité Maritime International on 17 May 2025. The text aims to identify the universally applied fundamental principles of maritime law, to clarify the distinctive features of this field, and to contribute to the international uniformity of maritime law. CMI Lex Maritima is not an international convention, a model law or a legally binding instrument. Rather, it is a non-binding instrument derived from positive maritime law, which may perform a supplementary and guiding function only to the extent permitted by the applicable law. The text consists of 5 Rules and 25 Principles. These Principles cover the main subjects of maritime law, including the sources of maritime law, ships, obligations and liability in maritime law, maritime contracts, maritime casualties, salvage, general average, maritime liens and limitation periods. This study presents the Turkish translation not only of the Rules and Principles of CMI Lex Maritima 2025, but also of the General Introduction to the text.
